Terms & Conditions
Boundless Vision Ltd terms of trade. If you are considering or are already working with us please read through the following so you are aware of the conditions of services delivered.
“We”: Includes Boundless and all of our staff
“Our”: Includes Boundless and all of our staff
“You”: The client
“Raw footage”: The video & photos that come straight out of camera are not provided.
“Shoot or Production day”: The day we create the video or photos
“Post production”: The process of editing video and photos
What you own: The final edited videos and photos for use as you require in their final edit format as we delivered. You are also responsible to keep these safe either online or on hardware. You do not own the right to distribute the media to third parties for their advertising needs. Eg. If we have taken a photo of a home you are selling, you cannot give the photo to the home builders to use in their advertising without purchasing licensing rights. See below for licensing fees.
While you own the final edited video, this does not include the right to create new content from our video. If you intend to use footage from a Boundless Vision video in other projects edited by another party (other than Boundless Vision – eg. editing them into a new video) you need to notify us of this intent and ask if there is a licensing fee needed to use our footage in this manner. These requests will be analysed and handled on a case-by-case basis.
What we own: All the raw footage and the edited final footage. We obtain the right to use the final material for projects and marketing on Boundless Vision media platforms. We also own the right to distribute, eg. we can provide the above mentioned building company with a license to use the photography if we so choose.
Storage; We store footage for 3 – 6 months after delivery of the final project. Sometimes accidents happen, we cannot be held responsible for the loss of footage, or if it has been deleted without us being notified to hold on to it by you. We hold the right to charge a fee for storage should you request that we keep footage for longer than 6 months.
Shoot or Production day cancellations and postponements for Real Estate;
We understand that in our business the weather plays a huge part in delivering the absolute best imagery of a property or project and we will not penalize you for weather not playing its part. Therefore we do not charge postponement fees for shoots rescheduled due to weather or Covid related illnesses that make the property or its habitants or agents unable to provide access to the property.
All other postponements and cancellations will be treated as below at our discretion:
1 x Free reschedule up to 7 days from the shoot date
Rescheduling fee for changing within 7 days of the shoot: $75
Rescheduling within 48 hours from shoot: $150
Cancelation fee: $150
Corporate & commercial project cancelations: This type of work takes a large time commitment from us and when we commit to exciting and big projects, it requires us to block our schedule out which means we are unavailable for our regular weekly clients for the period of the production.
Cancelation before 7 days of production: We charge for all the work that was done to date and any costs acquired, eg, scriptwriting, accommodation bookings and all pre production work completed.
We charge for all the work completed as well as 50% of the on the day production costs should a project be cancelled 7 days prior to production.
We charge the full production charge if cancelled within 48 hours.
Hours/Days of Operation: We ordinarily provide media services Monday to Friday, 9am to 5pm. We do offer services outside these hours including sunrise, sunset and twilight shoots. Information regarding these can be found on our booking form or by enquiring. We may also provide services on weekend days by application only and may or may not be able to provide such services depending on the availability of our production team. Rates for weekend work can incur a 25% surcharge, this will be communicated upon booking.
Cleaning Fee: Should we arrive to complete media services at a property and find furniture, fixtures or decorations not in the appropriate position or state we hold the right to charge for the time taken to make the set media ready. The fee for this is $150 and will be invoiced without prior notice given should this service be required in order for media to be completed on shoot day.
Decluttering: A media team’s job is to capture what is there, we therefore cannot be held response for the state in which a property or film set is presented. Although we go out of our way to declutter while we shoot, should we feel that a property is not on proper hygiene levels, we hold the right not to touch the surfaces of that home. It is the responsibility of the client to ensure a property is properly prepared and ready to be shot upon our arrival. Please do not arrange for a property to be decluttered during our shoot as this effects the shooters ability to do their job. Please have the property decluttered before we arrive.
Tenanted properties: For the safety of tenants and their belongings, we do not declutter rental properties to the same standards we do owner occupied properties.
We do not wash dishes, vacuum, clean floors, make beds or perform any activity that is considered cleaning rather than decluttering. Should this be needed our cleaning fee will be charged.
On-set safety: As a responsible employer, we hold the safety of our employees as most important. We will not jeopardize staff wellbeing or put equipment at risk of damage due to properties or sets having or being hazardous sites.
This includes entering a property where Covid has been identified. We will not enter such a property and reserve the right to cancel a shoot or project booking should a property or site be deemed to have infected residents at your expense, if we have not been made aware prior to shoot day.
We will abide by standard government and ministry of health guidelines in terms of PPE and social distancing as announced and/or changing levels in future announcements. We require you and any of your company representatives or vendors or property owners to wear the appropriate PPE in line with official guidelines as above.
On specialist building sites all industry standard PPE must be supplied for Boundless Vision staff and appropriate risk management or hazards are to be identified by you or your company representative.
Licensing; We have the ability to grant licensing use of our images on written request. Only on confirmation and payment of licensing should you use our images. The following licensing options are available to named license holders only:
Website and Social Media Commercial license: $150 incl.
This includes access to the photos (usually over 30 images) and lifetime usage of the imagery on web & social media.
Website, Social Media & Print Commercial license: $200 incl.
This includes access to photos (usually over 30 images) and lifetime usage of the imagery on web & social & print media.
Website, Social Media, Print and Large format Print: Commercial license: POA
This includes access to photos (usually over 30 images) and lifetime usage of the imagery on web, social media, print and large format printing: Billboard advertisement, ie. Mall entrances, on the back of buses, traditional billboards etc.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
Promotional Terms
To qualify for the discount advertised in this promotion, please mention at the time of inquiry that you wish to qualify for the promotion. We cannot be held liable to provide any discount if this was not part of the initial inquiry.
Not all media production inquiries and projects are fit for what Boundless Vision produces in the photography and videography space, therefore all inquiries will be assessed and need to undergo an official onboarding process. After the initial inquiry and meeting, we will advise whether we are suited to produce the media your project requires and whether the project qualifies for the $1000 bonus. Should we be unable to sign a project up, we will communicate this in writing. If we cannot onboard your project this will be communicated before any agreement is stepped into or before any quote has been produced or paid. You will not be entitled to any money back or discount from Boundless Vision if we are unable to onboard your project or if the project does not qualify for the $1000 free media promotion.
The minimum project budget to qualify for the $1000 discount is $8000 excl. spent on video and photography services.
Should both parties wish to proceed in working together, the project will be quoted, signed off, and will be signed up under our general media production service agreement.
We only have capacity to onboard five projects under the promotional terms for 2023.
Intellectual Property
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
Your Feedback to Us
You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
Termination
We may terminate or suspend Your Project immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
